The Crumbling Of Our Constitution.
The preceding days to this post, the very foundation of the constitution of the United States of America has been challenged by it's sitting president, Donald Trump. By ignoring federal judiciary orders and therefore violating the checks and balances the judiciary is suppose to have on the executive branch. This is an absurd overreach of executive power, even called out by the conservative Chief Justice John Roberts.
You might wonder, "Well, so he ignored one order, is that really a big shift from what's going on right now?" Well I think so. The case involves the use of habeas corpus, something that is even a stain on President Lincoln's presidency. American's famously hate the use of it because if calls for termination of due process and the legal rights provided to normal citizens at normal times.
Whether if you agree on if the people involved in this cases should legally be allowed to be here, is besides the fact. Not only did Trump use habeas corpus, but he did so against the one check and balance he has against him, especially in the short term. If if you disagree with what the judge had ordered, the fact he had done so was the same thing that has been keeping our nation running since the 1700s.
We are witnessing a man who increasingly values his wishes more than the rule of law and the system our founding fathers have set up. It's a dangerous precedent that may go on to damage us even after his current term. Much of what Donald Trump has done and gotten away with has created precedents that can only be dealt with properly through either legislation or constitutional amendments, ones that clarify the exploits and weakness that they use.
The questions for the future are:
How far does Trump continue to push his ignoring of federal orders?
Does he employ this tactic with other goals of his administration? If so which ones?
How does the Supreme court respond to this, and future actions of his administration?
Does this shift any of the outcry against the admin. either publicly or within congress?
